Professional Conduct and the RICS Rules of Conduct

Avalon Surveyors Ltd is a firm of chartered building surveyors regulated by RICS. This page explains what that regulation means for our clients, summarises the RICS Rules of Conduct in our own words, and sets out how we meet them.

Our regulatory status

The RICS Rules of Conduct

The RICS Rules of Conduct came into effect on 2 February 2022. They apply to every RICS member and to every firm regulated by RICS, and they contain five rules. The headings and summaries below are our own; the Rules themselves are published by RICS.

1. Professional behaviour

In summary: act honestly and with integrity, and meet every professional obligation, including those owed to RICS.

How we meet it: we give objective advice based on evidence and are open about our fees and the scope of our service. We keep client information confidential. Before accepting an instruction we check for conflicts of interest and record the outcome, and we decline work where a conflict cannot be managed within RICS requirements. We do not let gifts, hospitality or referral arrangements influence our advice, and we do not facilitate bribery, fraud, money laundering or tax evasion (see our Anti-Bribery Policy). We do not hold client money.

2. Competence

In summary: stay competent, and make sure work is done by people with the right expertise.

How we meet it: we accept only instructions that we have the knowledge, skills and resources to carry out well. Work is supervised, and we check the competence of any subconsultant we appoint. Our chartered surveyors plan and record continuing professional development each year, as RICS requires, and we keep up to date with the legislation, RICS standards and technical guidance that apply to our services.

3. Service

In summary: give clients a careful, diligent service of good quality.

How we meet it: we agree the scope, limitations, timescale and fee of each instruction in writing before work starts, and we tell clients promptly if anything needs to change. We tell clients that we are regulated by RICS and that RICS may ask to see our records for regulatory purposes. Advice is checked before it is issued and proper records are kept. Our Quality Policy describes these arrangements.

4. Respect

In summary: treat everyone with respect, and support diversity and inclusion.

How we meet it: we treat clients, occupiers, neighbours, contractors and colleagues courteously and fairly, and we do not tolerate discrimination, bullying or harassment (see our Equal Opportunities Policy). We take steps to check that our supply chain is free from modern slavery and other abusive labour practices (see our Modern Slavery Statement).

5. Responsibility

In summary: act in the public interest, take responsibility for what we do, prevent harm and protect public confidence in the profession.

How we meet it: anyone working for us can raise a concern with the Director and will be supported for doing so in good faith. We respond to complaints promptly, openly and professionally, and we never discourage a client from using independent redress or contacting RICS. We cooperate with RICS, and we report significant concerns to RICS where the Rules require it.

Our obligations to RICS as a regulated firm

RICS also places specific obligations on regulated firms. We:

  • publish a complaints handling procedure that gives access to an independent redress provider approved by RICS (for Avalon, CEDR), and keep a log of complaints;
  • hold professional indemnity insurance covering our current and past work that meets the standards approved by RICS;
  • cooperate with RICS and provide information it reasonably asks for;
  • show that we are regulated by RICS on our website and business documents; and
  • tell RICS about any matter that the RICS rules for registered firms require us to report.
